The law is never something to take lightly especially when the specific law is set in place to prevent the loss of human life. Gun control laws have a basis set by the federal government and are expanded upon by each individual state as they deem fit. Federal gun laws and state gun laws have their similarities and differences, but both are set in place as a barrier of protection against those who could cause bodily harm to others if equipped with such power that a gun holds. The U.S federal Government has its own set of regulations concerning firearms and the state of California builds upon them to create a stronger gun policy, meaning both sets of codes and regulations have similarities and differences, but no matter the differences, these laws are set in place to prevent massacres like the Las Vegas, Nevada shooting, and while California gun laws are built upon federal laws, they can be improved for a safer more controlled environment.

Passing gun control legislation that creates a universal background check and gun database system as well as passing mental health legislation that improves the health care system’s protocols and policies for assisting people with mental health disorders and that enacts counseling programs in communities and schools will decrease the likelihood of mass shootings in schools. The United States is bitterly divided. Issues of great concern, such as the rise of mass shootings, are partisanized. Both sides of the debate will not comprise or listen to what their opponents have to say. Groups from both sides can only agree that one innocent life taken from gun violence is one too many.
Seventy people are shot, twelve which lost their lives. How did this happen? How did the gunman obtain the weapon? This could have been prevented. Criminals don’t follow laws. Gun control laws are more oppressive on citizens than criminals, which is literally someone who has broken, or is breaking, a law. Why are some gun control laws and rulings so heavily pushed? Especially considering that the majority of these laws have very little actual basis aside from the “guns are scary and bad” train of thought. This is going to be going into why most of these laws, current, and proposed, make no sense such as the Magazine Capacity bans that some states are putting in place, the entirety of the National Firearms Act of 1934 (NFA), and the 1994 Assault Weapon Ban(AWB).
Throughout history, especially recently, the question of whether gun control violates the 2nd Amendment has been a question which many people claim they know the answer to, but it may not be that transparent. I believe gun control is constitutional, and it deters crime and makes society safer, meaning I side with the pro-gun control ideas. Within the topic of gun control, there are many factors in which people must take into consideration when proposing an answer such as whether it deters crime, what the economic impact is, and what should be changed. In fact, each state has different laws for gun control. Some states such as New York and South Carolina have prohibited open carry for handguns while other states have zero restrictions for handguns. Mass shootings, people shooting police, other citizens, kids, and harming the innocent, is unfortunately the world we live in today. Many Americans, myself included, wish there was one fell swoop law, rule or act of magic for that matter that would stop all this reckless destruction overnight. The hidden truth is that even if we take guns away, or ban certain items, people will always find ways to harm others. One major item many Americans want to see happen is tighter, and more gun control laws. In 1791 James Madison declared that United States citizens should possess the right to bear arms to maintain a free state (Hornberger). Many Americans question what this founding father meant and which guns this included. The Second Amendment ensured that the citizens of the new republic could fight against future tyrannies (Hornberger). The first significant gun control law passed in 1934 placed tax restrictions on weapons favored by mobsters (Lewis). Since this act passed, the United States added several major gun control laws, each making obtaining a firearm more complex (“Concealed”).
Still, the United States has an incredibly high crime rate and it is incredibly easy to buy guns. In 2015, a man with apparent emotional problems, Vester Flanagan, was able to pass a background check and acquired two Glock 9mm handguns before he went out and shot a reporter and her cameraman on live television (Johnson). A federal law enforcement officer cited the lax background checks, saying that if they had been stricter and more thorough, Flanagan would not have been able to shoot and kill two people. Gun control is a rising issue in the United States, it is heard about in the news, social media and among the public. Before choosing a side, look at the facts: “Beginning with Columbine in 1999, more than 187,000 students attending at least 193 primary or secondary schools have experienced a shooting on campus during school hours, according to a year-long Washington Post analysis.” (COX 2018) “That could never happen in my school” is what all students, teachers and parents say when they watch a news report on another school shooting. Nowadays, children are so accustomed to the idea of school shootings, even children of ages that don’t know how to do long division.

The information recorded of the details of the most recent mass shootings prove that they included firearms purchased from legal gun dealerships. Firearms can be obtained too easily and the absence of stricter firearm laws is the absence of safety in the U.S. b. In this world, there are too many people that have died from guns. Some of them have died in large-scale attacks, some of them were in a gun accident. Many want more gun control laws to be passed. There are as many people who advocate for pro gun laws as the people who are opposed, which is the reason why gun control has become one of the most controversial topics as of right now. America is truly split between those who advocate for gun control and those who are opposed.
The con side of gun control laws made good points as to why more laws would not be in the benefit of the people but they did not provide credible sources to increase the credibility of their claims. A lot of their references included well known newspapers such as the Chicago Tribune and the NY Times. While they did reference the Supreme Court, US Fish and Wildlife Services, and the Heritage Foundation I believe that these few sources are not enough to support their claims and make them credible. When looking at their Top Con quotes I found that they used a lot more credible sources such as US representatives, senators, and the Founder and President of Crime Prevention Research Center. Therefore they were able to make their claims more credible.
