Case Brief: Ferjo v. Ontario Human Rights Tribunal, 2011 HRTO 222 Purpose: Kimberley Ferjo commenced an application against the Ontario Human Rights Tribunal for sexual discrimination. The tribunal had to determine whether Mrs. Ferjo faced discrimination after being previously denied legal representation and if her application should be dismissed. Facts: Mrs. Ferjo acted as a representative and witness for VideoComm Technologies during a hearing before the Ontario Human Rights Tribunal. The hearing was based on allegations that VideoComm Technologies had discrimination against a pregnant employee. VideoComm Technologies was ordered to pay damages at the end of the hearing.

Greatly valued in the west, Canada is proud to have a set of rights and freedoms granted to every one of its citizens. Under the Canadian Charter Rights and Freedoms, it dictates what the state’s citizens are entitled to, which can involve the right to expression and the right to equality. Of course, there are reasonable limitations to these rights, such as restricting what sort of speech is free, but since the September 9, 2011 attack in New York City (hereby referenced as 9/11), the Canadian government has been passing legislature that has been cracking down hard on these rights. Canada is talked amongst other countries throughout the world as a safe, secure place to live. Majority of people do not know the heinous crimes that take place in Canada daily, especially whilst using a gun. Canada does not come close to the United States when comparing mass shootings, death by a gun, or homicides using a gun; although, the gun crimes in Canada are not improving. While Canada has more stringent gun laws than the united states, gun control in Canada should still be improved for citizen’s safety. Canada is often praised for having more efficient gun laws than the United States, but most people do not know that Canadian laws too, have much room for improvement.

In society and college campuses, sexual assault occurs quite frequently. According to an estimation one third of women experience a forced sexual experience at least once in their life and most of the time it occurs in colleges. Men have also been reported to be victim of sexual assaults mostly by other men. Most of the time the sexual assault is planned and perpetrated by a third person, who is known to the victim of incident. Drug and alcohol use play role in this issue and contribute to the problem as most of the time the victim and perpetrators are under the effect of alcohol or any other drug during the incident.

Sexual violence can affect anyone. There is no end all be all strategy to avoid any and all sexual violence. However, studies have shown that some people are more likely to be affected by sexual violence than others. Typically, the people most likely to be at risk of sexual violence are people who are disenfranchised, in prison where a whole different cultural dynamic exists and people who can’t care for themselves. Just a few of these groups are Native American women, male prisoners, and children.

Indigenous peoples of Canada have been considered inferior to all other citizens, and have been abused and neglected through European history, and can be seen as a form of genocide. In Canadian residential schools, children were removed from the home, sexually assaulted, beaten, deprived of basic human necessities, and over 3 500 women and girls were sterilized, and this went on well into the 1980 's (Nicoll 2015). The dehumanization of Indigenous peoples over the generations has left a significant impact on society today; the generational trauma has left many Indigenous peoples heavily dependent of drugs and alcohol, and the vulnerability of Indigenous women has led to extremely high rates of violent crime towards these women. According to Encyclopedia of Psychology, sexual abuse is unwanted sexual activity with perpetrators using force, making threats or taking advantage of victims who are not able to give consent. Most of victims and perpetrators know each other. In sport, women athletes are more frequent victims of harassment and abuse than men athletes. Many women athletes drop out of sport rather than continue being subjected to the constant harassment and abuse.

It is solely the responsibility of the employer to ensure that all employees within are aware and are very cautions of laws, misconduct, and liabilities. Employers must enforce the Policy Prohibiting Discrimination and further extend those laws and guidelines to their employees.

Gender discrimination has immensely increased as men have given preference over women in countries.
