The First Amendment to the Constitution of the United States of America grants the right to free speech a status superior than that of the other rights. Specifically the First Amendment disallows Congress from establishing any laws controlling the freedom of speech.

In RAV v City of St Paul Minnesota 505 US 377 (1992) a person placed a burning cross on the private property of an African American couple in violation of a city ordinance which decreed it an offence to display a thing on any property which evokes distress, fear or antagonism on inter alia racial grounds. The court disregarded the defense that the burning cross was protected by the entitlement to free speech and that the ordinance’s violation of free speech entitlement was constitutionally invalid, holding that the burning cross represented aggressive abhorrent racism. Another limitation that does not protect citizens under the First Amendment is using fighting words that disturb the peace. In April 1940, Walter Chaplinsky was in downtown in Rochester, New Hampshire handing out literature and speaking publicly about religion. As Chaplinsky continued to talk, the crowd continued to grow, blocking the streets and disturbing the area. The public around him became upset with Chaplinsky as he began to denounce religion as “racket”.
In my opinion, I would believe that the first amendment of the U.S. Constitution to be the most important amendment out of all twenty-seven amendments. Moreover, the first amendment would be the most dynamic of all the other amendments, laying a resilient groundwork towards the other amendments. Correspondingly, the first amendment decrees American’s the right and freedom to free speech, without restriction or limitation. As, the first amendment right permits individual to speak up against injustice, speak out against the government, and express our religious views. After all, I strongly believe that no individual should be limited to what they can say.

Chapter 4 of the book We the People talks about Civil Liberties, this chapter mainly talks about the Rights that were placed in the Constitution (not in the Bill of Rights), it also talks about the Bill of Rights and it describes the rights protected by the Bill of Rights. When Doug Hann, a varsity football player at Brown, became intoxicated while celebrating his first birthday he began to shout obscene language filled with racism, homophobia, and anti-semitism at nearby students and almost found himself at an altercation with one (Hentoff). Needless to say Hann was expelled; however, a debate ensued whether his expulsion was truly just. Though at first glance, Brown’s code seemed to be thorough it was actually flawed as it states that the school “prohibits inappropriate, abusive, threatening, or demanding, actions based on race, religion, gender, handicap, ethnicity, national origin, or sexual orientation (Hentoff). It was the usage of the word actions that spiraled the debate as speech is not an action. Hann was expelled for speech.
