The First Amendment says that we are in tiled to your own freedom of speech even as a minor. In schools the teachers are trying to limit what students can say, do, or wear. There should be some restrictions placed but not as many as there are. It should stay where students have freedom of speech because it opens students up for more opinion in the class and on there work. It also lets students feel like they are not being controlled by someone.
But having total freedom of speech can be good and bad. Some bad things are that people will say lots of negative things. When the students say these negative thing there is nothing the teacher can do because of the students freedom of speech. This is also bad because the students will start to feel
As seen in previous cases like Tinker vs. Des Moines, students have the right to political say, unless it causes disruption at school of students are promoting something that goes against the law. In the case of Tinker v Des Moines the students were not promoting anything illegal but showed their thought on the Vietnam War by wearing black armbands (Tinker). Argued in court by Kenneth W. Starr in the Morse v. Frederick case, he gave the idea that the foundation for school censorship was the case of Tinker v. Des Moines (Morse). The Justices responded back saying, that case was a different scenario as the students weren 't doing anything against the law while Frederick was encouraging the use of marijuana which was illegal (Morse).
One must have evidence that a disturbance has been make. Fear cannot take away freedom. In one of the court cases mentioned, it says, “the vigilant protection of constitutional freedoms is nowhere more vital than in the community of American schools,” (13). This is saying that our constitutional freedoms are most valuable in American school communities. The freedom of expression is one of the reasons that makes America a superior country.
Concealed Guns Imagine this you're a student at ISU and concealed guns are banned on college campus while you are in class the weird guy in the back pops up and starts shooting people in a few seconds your dead or injured but maybe if guns were allowed on college campus when the first shot went off you or someone else with a concealed gun could have shot the man and probably saved many people's life. Even though this is not a true story this has happened at other colleges around the united states. Well are concealed guns good or bad are they useful or not. People say concealed guns owners are a treat or dangerous. With all these people saying they don't help the community there dangres the owners are a treat.
1st Amendment and the College Campus Have you ever wondered why some college campus protests are shutdown even though the first amendment is in place? The first amendment does not always protect in every situation. The first amendment wasn’t enforced much until the 1960’s and 70’s, when the anti-war and gender equality protests first started. College campuses have a right to impede on the first amendment if it is restricting someone else’s rights. In many cases some protesters will block off an entrance to an event or will start to harass people walking past.
Why Should teachers be able to carry a gun. Reason #1 for teachers being able to carry a gun, protection of students. Imagine being a parent in this day and age were you have to worry about your child going to what was a safe environment in the parents age. I can’t fully express anything that I want and its due to the security and general welfare of other fellow peers. A lot of class work has to be censored and cant be used for the sole purpose of education. We too, students, are persons under the American Constitution . So so this extent, i can say that our government has altered the first amendment.
The freedom of speech allowed the textbook to be added to the school in the first
"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized". The 4th amendment was made based on the Founding Fathers ' experience with the Kings agents and the all purpose writ of assistances that they used abusively. Without the 4th amendment, we would be at the mercy of the police because they could come into our household, search anything and take whatever they want. "A reasonable expatiation of privacy" the 4th amendment secures the protection of the
Censorship Censorship in schools may not be the best choice for enriching the future minds of the United States of America. Children of the United States of America should have the right to learn about anything for it is there amended right. Taking knowledge away from them and censoring it should not be the answer to keeping our Children pure it should be what we teach our kids. [21]” (ProCon.org). Banning books in school can create a problem for the teachers that are trying to assign something to the class. With the new addition to the first amendment schools will have the rights to any books. When books are banned the life lessons in the books are also
Hypothetically, a law is passed stating that teachers are allowed to carry guns in school. In a sick twisted world, the teacher becomes the school shooter. Your student is in class and their teacher pulls out their government funded school weapon and starts shooting. How is your child supposed to protect themselves if the approved district teacher starts shooting the students with a malicious intent. Teachers should not be allowed to carry guns at school.
What if your middle school girl came home from school one day and told you that she had to wear boy’s gym shorts because the yoga pants she was wearing turned boys on. Free speech and hate speech can be classified as different topics and when arguing for one, we can also criticize the other. Free expression and free speech on campuses are crucial for sparking important conversations about equality and social justice, and the suspension of free speech and expression may have dire consequences on college campuses. First, freedom of expression allows students to show their own political, social, and cultural views, while also allowing students with common beliefs to align. Free speech and the call for free speech allows those who have been historically systematically oppressed to use their voice.
In Nat Hentoff essay, “Should This Student Have Been Expelled?” he debates that freedom of speech should be valued no matter how it is taken by others. The one example that pops out to me is the student at Brown University, Dough Hann. He states many offensive things about several people and is expelled because it was not the first time something like this has happened. Freedom of speech is difficult subject that has many different views on it.
Is there negative and positive sides? History: The belief in the right to free speech is older than we believe it is. It actually goes back to the ancient Greeks (Antiquity).
