IV. Addressing the opposition A. Argument 1 The Plaintiff has argued that this regulation is in best interest for the public and provides security for the society as a whole. They want the regulation to be considered Constitutional because it was voted on by the majority and therefore, it is in the best interest of the community and should therefore be enacted. This argument does not speak to the constitutional issue of the case. The Supreme Court’s main objective is to protect individuals and minorities from oppressive government.

The United States Constitution when first introduced was focused only on what powers the Federal Government would have. For many states who had just gained, their freedom from England there needed to be a guarantee that the newly formed government would not impose on people’s rights. The Bill of Rights was written for that purpose it was to apply to the federal government only. When different states started to pass laws that contradicted what the states had requested from the federal government when they added the Bill of Rights, which unfortunately prevented the federal Supreme Court from intervening in the states business.

Over time, there have been many interpretations in the meaning of the 14th Amendment due to the use of both explicit and implicit language in the document. Having been written at a time when African-Americans were starting to get their rights. For some at that time, the 14th Amendment meant to just give African-Americans rights but as time progressed, the interpretation of the amendment was challenged and began to change. The 13th Amendment’s meaning is to end slavery in the United States except as a punishment for a crime. The 13th Amendment didn’t help African-Americans because states passed the Jim Crow laws.

The 14th amendment was written after the Civil War to protect Naturalized citizens of their rights and equal protection of the law. The amendment resolves the legal status of former slaves, even though there was still a lot of confusion over newly freed slaves African Americans were still restricted in the southern states. Black children weren’t allowed to attend schools with white children because of the segregation laws but after a lawsuit was filed 1954 Brown v. board of education, the separate but equal is unequal, so the segregation laws were abolished in 1964 by the Civil Rights Act. Before, during, and long after the Civil War blacks were discriminated against in almost every form of life. They had to fight and be patient to be accepted as equals among their white counterparts; this process took form over a long period of time, and after many failures, blacks were truly equal in the eyes of the government. The thirteenth, fourteenth, and fifteenth amendments which were passed in the late 1860’s were supposed to bring political, social, and economic equality for the blacks; however, this was not the case, while in some facets of life blacks obtained more freedoms they had to wait many years after these amendments were passed to be fully equal to whites. The thirteenth amendment abolished slavery in the United States.

The 13th amendment is a movie about politics and what was occurring during the civil rights and what 's happening now. In the movie there are many people who are in this documentary are colored people who can relate to what has happened. This documentary also relates back to what is happening now that Trump was elected president and the racism there has been since he went into the White House. The documentary kept showing clips from the civil rights movement and martin luther king, along with other civil rights leader.

The purpose of the 14th amendment is to provide citizenship to people born in the United State and allow people to become citizens. This helped freed slaves acquire citizenships under the 14th amendment giving them the rights and freedom in the United States. According to America 's library,

Post Civil War, African Americans started to gain rights to gain rights, and soon gain rights equal to whites. While there were some people/things standing in their way (KKK, Black Codes), in the end they got what they needed; Equality. Many acts and laws were passed to aid the new rights now held by African Americans, as well as the numerous people willing to help. New Amendments were added to give African Americans rights after the war, all giving them some equal rights to whites. The first of the three added was the Thirteenth Amendment, it gave African Americans freedom from slave owners, and stated that no one could be kept as a slave in the U.S..

The 14th amendment is split into five sections. Section one is the most important of them all and it states, “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.” (The Constitution 2014). The society that has created this sets of laws or were created by a strict government to control a religious people, hinted by the lack of a 13th law. This laws were separated into three groups the first being trade and the dealing between two people or parties. The second was the matters between families, and the last of the matters of payment from one party to another. The society shown would have been one of wealthy and high population due to the number of rules revolving around slaves, prostitution, inherited land, and crop or animal trade.
