Dred Scott V. Supreme Court Case

Board of Education is a very important landmark case. This case addressed the constitutionality of segregation in public schools back in the early 1950s. When the case was heard in a U.S. District Court a three-judge panel ruled in favor of the school boards. The plaintiffs then appealed to the U.S. Supreme Court. The Supreme Court went through all its procedures and eventually decided that “Separate educational facilities are inherently unequal” ().

Today the trial, Scott V. Missouri, which was Dred Scott, a slave owned by Irene Emerson, suing for his freedom, had taken place. The trial had started out with a witness for prosecution, who stated that due to Dred Scott’s status as a slave, that he didn’t have any rights within the constitution. He went on to claim that the constitution only covered people and therefore, Dred Scott was only considered property and had no rights. In addition, the witness made the argument that due to Missouri law, Dred Scott was still considered a slave since he still resides within Missouri. During their argument, the Supreme Court questioned the witness about what the definition of a person was in the constitution and whose job it was to debate the Constitution.

When one holds a prestigious position on the United States Supreme Court, they possess the opportunity to alternate the future of the country. However, that impulse should not be entertained in the majority of instances, as with the Dred Scott Case of 1857. Although that conflict should have dissolved after the subject dissolved, Chief Justice Roger Taney allegedly overextended his reach to determine the legality of another issue that had troubled the United States. In addition, the decision decided on the case itself negates the framework of the U.S. Constitution by infringing on an individual’s rights, regardless of who they might be. At the time of the Dred Scott Decision, the United States had become deadlocked over the controversy

The aftermath of the Kansas-Nebraska Act began the violence known as Bleeding Kansas, which was the result of countless conflicts of pro-slaver and anti-slavery settlers. To make matters worse three years later, the Supreme Court issued its decision on the Dred Scott v. Sandford case. Chief Justice Roger B. Taney stated, “… the right of property in a slave is distinctly and expressly affirmed in the Constitution. The right to traffic in it, like an ordinary article of merchandise and property, was guarantied to the citizens of the United States, in every State that might desire it, for twenty years. And the Government in express terms is pledged to protect it in all future time….”11

Property, a building or buildings and the land belonging to it or them. Are humans land? Apparently they are. In 1857, Dred Scott was treated as property, which someone should never experience. The Dred Scott Decision was important to American history and eventually led to the Civil War.

Stanford case was not the most impactful, it still lead up to the equality of white and black people. This case all started when Dred Scott left the state alongside his owner, Dr. John Emerson. They moved into a free slave state, which meant that slavery was not legal in that state. They lived there for four years, Scott met his wife here and in addition, also had young children. After the four years they moved back into a state where slavery was legalized.

The Dred Scott decision showed Americans that colored people are just things you own and not people at all. This helps slavery, which at the time was a very big thing in the south. Slave owners now can own and keep their slaves because now they can’t run away no matter what. Even if people are “free” and go to a “slave free” state, they can still be arrested and sent back to their slave owners. This was a huge win for slave owners and a loss for the north as they wanted more people for jobs.

America’s founders created the constitution in order to create unification and order in the United States. However, there have been controversy surrounding the interpretation of the constitution, this has caused debate over many issues within the country. These issues and the lack of wartime policy within the constitution directly lead to the Civil War, which was one of the worst alterations this nation has faced. The Missouri compromise, the Dred Scott decision, and Bleeding Kansas were controversial issues surrounding the constitution that directly lead to the Civil War.

This case was interesting because Laci was a very beautiful and seemingly young, friendly, and happily pregnant woman with lots of friends. Her husband, although attractive, had a kind of macho tough guy womanizer type of persona about himself. It is hard to believe or fathom someone being so cruel as to kill their pregnant wife, regardless of their marital problems. Laci came up missing on December 24, of 2002, the day before Christmas.

The current USA wouldn’t be the country it is today if discrimination was not noticed. Dred Scott surely showed that white people were treating the black people differently. This made the people start to argue about their skin color rights and caused everyone to be equal

In the Plessy v Ferguson case, it resulted in the agreement of ‘separate but equal’ which is the opposite of what was needed to bring the Civil Rights movement forward. This is opposition to African American’s because they ruled for segregation. The Strauder v West Virginia case is also an opposition to African American’s as it was ruled that only White American’s were to serve as judges in the Supreme Court. Finally, the Williams v Mississippi case was opposition to African American’s because it ruled that to be able to vote, you had to be able to pass a literacy test. This was opposition to African American’s as a lot of them would not be able to pass a literacy test as they would not have been educated well enough if at all to be able to pass a literacy test.

Supreme Court Decisions Setting Precedent Discrimination may not seen as big a problem today, but people had to fight for that problem, and court cases set precedents for today. The case of Plessy versus Ferguson and Brown versus Board of Education helped change the way we view discrimination today. The case of Plessy versus Ferguson decided that segregation was legal as long as everything was equal. But on the other hand, Brown versus Board of Education included separate but equal schools made African-American children feel inferior to the white children. 1896, Supreme Court heard the Plessy versus Ferguson case.
