Compare And Contrast The Three Fifths Compromise And Commerce Compromise

As mentioned in the module, "Lecture Notes for Chapter 2 The Constitution", the Three-Fifths Compromise or "the three-fifths rule", was put into motion as a way to appease Northern delegates while also preventing the Southern delegates from leaving the convention. The compromise ultimately states, "The three-fifths meant that the House of Representatives and the electoral college would be apportioned in part of the basis of property--specifically, property in slaves" (Bardes, Shelley, Schmidt 42-43). In other words, this referred to slaves in that each one would be counted as three fifths of a person, which benefited slave owners the most as that meant they would have more people from the South when it came to determining the representation in Congress. which is how the interests of Southern states were addressed.

Over 200 years ago during the summer of 1787, our great American leaders discussed, argued and compromised to create the constitution that we have today. After the failed Articles of Confederation, a weak government that had no power to tax, a new form of government was in order. Congress decided instead of changing the Articles of Confederation, they would create a brand new government at the Constitutional Convention. In the early years, after winning independence from Great Britain, the American colonies set up their government in accordance with their first constitution, the Articles of Confederation. This means that the majority of the power laid in the hands of the states and Congress, “the only institution of national authority” (Brinkley 151) at that time, had very little power. This distribution of authority was the manifestation of the American’s fear of a strong, central government. However, as time passed, more and more people came to agree that the national government was too weak and needed to be strengthened.

This act made any official who did not turn in a runaway slave liable to pay a fine; therefore, truly enforcing the law and safeguarding southern property. This also made every Northerner responsible for turning in runaway slaves. In Stephen Douglas’ “Speech Defending the Compromise of 1850” he stated, “Congress, after a protracted session of nearly ten months, succeeded in passing a system of measures, which are believed to be just to all parts of the Republic, and ought to be satisfactory to the People. ”7 Douglas believed by making this concession, the south would remain a part of the union.

At the Constitutional Convention, our founding fathers met to reconstruct the Articles of Confederation, not knowing that they would create the United States Constitution, an entire new format of government. They wanted to create a government that was powerful yet restricted in certain ways, in order to create equal representation for all people. Three main compromises were made at the Constitutional Convention. These compromises were The Great Compromise, the Three-Fifths Compromise, and the addition of the Bill of Rights.

The Fugitive Slave Act of 1793 was an Act of the United States Congress to give result to the Fugitive Slave Clause of the U.S. Constitution. In this acts, south purposed to assist the recapture and extradition of runaway slaves. In addition, they intended to make federal government giving a pledge to let holding property in slaves be legal. The international slave-trade clause restricted slavery after 20 years. It was May, 1787, when representatives from all over the country came to Philadelphia, Pennsylvania. Their secret being the meetings and the discussions that took place here. They kept it unknown by the media and people so that they could say as they please without unwanted pressure. They created these meetings with the purpose of revising the Articles of Confederation, on account of much needed to be done.

The Northern states, smaller in comparison to the south, already did not have as much representation and political power as the southern states. Therefore, the compromise to them was unnecessary, and they felt they would have all the power and dominate in the polls and decisions. Considering the different views the two already had based on slavery, this alarmed the northern states. However, as time passed, the Three-Fifths Compromise would not provide the advantage the slave owning south had hoped. The Northern states grew more rapidly in terms of population and ended up being opposing political power to others.

In the year of 1865, the 13th Amendment was passed by Congress. This Amendment formally abolished slavery within the United states. This ratification was the final consent to considering the Three-Fifths compromise obsolete; A compromise that was relevant for many years reforming the idea of how the slave count should be considered into the population of the United States. Not only did this Amendment shatter the idea of giving slave three-fifths of a count toward the population, this was the first formal movement towards giving slaves an identity.

One of the compromises made in the Constitutional Convention is the three-fifths compromise. In this compromise, the southerners wanted to add slaves to the population of the state they lived in. If slaves were included in their state’s population, that state would be able to add more representatives in the House of Representatives. Northerners did not agree with that statement because slaves did not have the right to vote. After the delegates compromised, they agreed that only three-fifths of the slave’s population would be counted into the state’s population.
