Confederation and Constitution After America won the revolutionary war, there was no united nation, rather thirteen independent countries instead of colonies. Therefore, an agreement was necessary to hold the independent colonies together. Thus, the Articles of Confederation fulfilled the purpose of forming the first American government. Drafted in the year 1777 and ratified by the thirteen states in 1781, the Articles consisted of various provisions that would help build a new nation. The Continental Congress had very minimal power under the Articles due to which it could neither establish a federal judicial nor deploy the army or the federal police for enforcing the laws. Since the Articles could not solve the rivalry among the thirteen states, the Constitution replaced it in the year 1787 as there was a necessity of establishing a strong and powerful national government. There are various notable similarities and differences between the Articles …show more content…
According to the New Jersey Plan, the delegates demanded more power in the control of the states. Therefore, Roger Sherman and a few other delegates came up with the Connecticut Compromise, also known as the Great Compromise, which proposed the division of Congress into two sections, the House of the Representatives and the Senate. According to the plan, the number of representatives constituting the House would depend on the population of each state, which there would be two Senators for each state irrespective of the population. The plan also states that the House is responsible for all fiduciary responsibilities, while the Senate is responsible for foreign policy making and ratifying treaties. The Great Compromise was able to resolve the conflicts between smaller and larger
Before the U.S. Constitution there was the Articles of Confederation. The document could declare war, negotiate treaties, and control foreign affairs. It couldn’t enforce laws, tax, and raise its own army. What the Articles Of Confederation lacked was a strong central government. Alexander Hamilton called for a constitutional convention in 1786, and it took place in Philadelphia on May 14, 1787.
The main difference with the Articles of Confederation to the constitution is having the lack of Central Leadership in which we had didn’t have no national court system or judicial branch and an executive branch to enforce any acts passed by Congress as well being able to have presidential figure to represent America without a representative to conduct foreign affairs especially with Britain at the time. America wasn’t able to deal with internal and external threats since Congress could not draft troops and were dependent on states to contribute forces. The constitution fixed this by adding three branches executive, legislative and judicial also adding the checks and balances system. We also have an army now but congress has to authorize to
The Article of Confederation was a document that gave a national government to the United states, after the US declared independence from Great Britain. However, this was the first written constitution for the united states, and this was necessary to have a national government. In addition, after the March 1, 1787 the Continental Congress implement the new government into the thirteen states and the economy. Furthermore, the constitution was a form of government that protect the people rights, as a citizen of the United States.
The United Sates has operated under two constitutions. The Articles of Confederation was effective in 1781, and The Constitution which replaced the Articles in 1788. These two documents have much in common, but they differ more than they do resemble each other. The primary difference was the Articles of Confederation was an agreement establishing the United States of America as a confederation of sovereign states. Otherwise, the US Constitution is the supreme law of the United States of America, also a constitution embodying the relationship of the federal government with the states of America and the citizens of the US.
With the United States gaining independence from Great Britain, Congress realized that a document of law needed to be established to maintain its newfound freedom. The Articles of Confederation devised a loose union of the states and set up a federal government with insufficient powers. Pivotal matters as defense, public finance, and trade, the federal government was in favor of the state legislatures. Twenty-one years the United States was ruled by the Articles until they adopted the U.S. Constitution in 1787. This made it so that the nation was rules by a sovereign national government, but also the states were sovereign as well.
Millions of people died during the revolutionary war. After the U.S won they created a national government called the Articles of Confederation. The government was a government where the federal government didn’t have much power. People like Ben Franklin and James Madison realized it wasn’t working and they created a new government called the Constitution. The replacement of the Articles of Confederation with the Constitution was necessary for the U.S to thrive and survive.
The Articles of Confederation were written, ratified, and put into power in the years 1781-1789. The Articles of Confederation served as a written plan of government for the newly united 13 colonies. This gave the states a strong government power with a weak central government. This is because most colonists still had the idea that a strong central power for government would turn into a tyranny just like Great Britain. However, the Articles of Confederation failed due to many problems in the early colonies.
Under the Articles of Confederation, there was no Executive Branch of government, no power of taxation, no right for the central government to regulate trade, no way of enforcing any of the laws that it passed and no right to declare war (Congress 1). All thirteen states had to ratify unanimously any legislation for it pass (Blum 118). These restrictions severely limited the national government and made it very weak. “The impotence of Congress made the United States a beggar in the eyes of the world” (Blum 119). It order to rectify the problems created by the Articles of Confederation, a convention was called to rewrite the Articles, but, when the founding fathers gathered in May of Stemple 2 1787, they decided instead to write a new outline for the government of the new nation.
The Articles of Confederation and the Constitution are very alike. Like, they were both written by the same person, and they were both official government of the united states. Plus, They were both the laws of the United States government. However, there was a great connection between them it was that the Articles of Confederation was the first written Constitution. The AoC was used to make the Constitution with the weaknesses and failures of it.
Following the Revolutionary War, America had just gained independance from Great Britain and needed to form a new government. The Articles of Confederation were established as an attempt to create a government that was unlike Britain’s. Unfortunately, the Articles of Confederation had several weaknesses. When in the process of repairing those weaknesses, the Federalists and the Anti-federalists formed. The Articles of Confederation were very weak as well as useless to America and because of this, the Federalists and the Anti-Federalists could not agree on a new type of government.
The Articles of Confederation were a document seen as the “first” constitution of the United States. This document granted the new national government power to control the military, declare war, and create treaties between the states. However, the Articles had holes in it considering the government did not have the power to tax, create laws without at least nine states’ approval, or change the Articles of Confederation without a unanimous vote. This means that the country soon fell into debt and petty arguments between state, the new government had no control. It was time for a change.
The Articles of the Confederation was the first form of government created by the Continental Congress, which developed an alliance between the thirteen states. Congress was a single-chamber legislature which allowed for each state to possess the same amount of authority no matter the size of the community. The Constitution
They hoped to create a better government. The Constitution replaced the Article of Confederation permanently in March 4, 1789. The Constitution created checks and balances between the three branches. It also, established the Bill of Rights, and the first ten amendments of the constitution. The Constitution had to be ratified by at least nine states out of thirteen.
The Articles of Confederation was an agreement among the thirteen original states of the United States that served as the first constitution. The Articles had first been introduced by Richard Henry Lee in the Second Continental Congress. Although the Articles of Confederation has made its contributions throughout history, the Articles, however, did not last very long and had been proven inadequate from the very start. I agree with this statement based on the examples and analysis of the Constitution I will soon provide. The Articles of Confederation were written during a time when the American people feared a strong national government.
The Articles of the Confederation was the first government constitution that the United States used, and, although there were strength like the Northwest Ordinance of 1787, there were major weaknesses of the Articles of the Confederation like the following: requiring 9 out of the 13 colonial votes from the representatives from different states to pass a law; having no executive and judicial branch; and the federal government being unable to impose tax revenue onto the states. Such flaws would eventually lead to the Constitution and the repeal of the articles, for the Constitution was a measure to fix the problems of the articles with a stronger government that allowed them to impose taxes and and implement new laws for a more effective government.
