13th tells the detailed story of how Thirteenth Amendment was used as a tool to use incarceration as a legal continuation of former slave system. According to the Section 1 of Thirteenth Amendment “Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction”. The amendment was ratified by required number of states on December 6, 1865, and therefore abolished slavery. However, the director of the movie not fully agrees with 13th amendment fully stopping slavery.

The black subordination social order had remained, unbroken by the abolishment of slavery or the Amendments that followed. The first sign of an attempt at a new social order was seen in Lincoln’s Emancipation Proclamation of 1862, where slavery was legally abolished in the Union states. Paired with Union victory at Antietam, emancipation looked to be a serious threat to the well-established institution of slavery in the Confederacy, or Southern states. Do you remember reading about the slave trade in our history books? And how Abraham Lincoln issued the emancipation proclamation which abolished slavery. But yet, under the 13th Amendment one is forced to involuntary slavery when convicted of a crime. Yes, it is the year 2017 and we can say slavery still exist. Saying that slavery was “Abolished” would be deceptive from my part, I believe it was put to an end but then reconstructed into the American Prison System.

Congress has the best plan for the U.S. Reconstruction. The plan Congress made gives freedmen the right to vote. It recognizes freedmen 's rights as well. Congress’s plan lets the Southerns keep their property but doesn’t reimburse them for all of their lost and damaged property. The plan uses military law and governors.

In the nineteenth-century, the Thirteenth Amendment, which abolished slavery, was ratified. Many believed that the Thirteenth Amendment ended slavery overall, but that is not the case. After ratification, slavery was a form of punishment used on convicted criminals. According to the United States Constitution, the Thirteenth Amendment states that, “Neither slavery nor involuntary servitude, except as punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction” (p. 4). This amendment removed the ability to gather free slaves that did not commit a crime.

The documentary, 13th, by Ava Duvernay highlights the exception of the 13th Amendment, the one line that states that slavery is abolished except as a punishment for crime. Despite those words being there from the moment the amendment was passed, everyone paid a blind eye to it and thought it was an amazing milestone in American history. In fact, this was never a milestone, throughout the past 150 years, despite all of the new amendments

The 13th Amendment abolished slavery in the United States of America permanently. Lincoln helped establish the 13th Amendment because he had to sign a joint resolution making the proposed amendment to the constitution to officially end slavery in the United States of America. Lincoln also states in the Gettysburg Address that “all men are created equal.” ( Document A) The quote also shows us his mindset on slaves and whether he thinks they should be free or not.

These efforts often took shape in the form of legal reform. During the mid-nineteenth century three key amendments, known as The Reconstruction Amendments were made to attempt to legally acknowledge the rights of blacks in America. The first was the 13th amendment that was ratified on December 18, 1865 and is associated with the abolishment of slavery. However the 13th amendment states that slavery is not allowed “except as a punishment for crime whereof the party shall have been duly convicted” (“Primary Documents in American History." 13th Amendment…).

The American civil war led to the reunion of the South and the North. But, its consequences led the Republicans to take the lead of reconstructing what the war had destroyed especially in the South because it contained larger numbers of newly freed slaves. Just after the civil war, America entered into what was called as the reconstruction era. Reconstruction refers to when “the federal government established the terms on which rebellious Southern states would be integrated back into the Union” (Watts 246). As a further matter, it also meant “the process of helping the 4 million freed slaves after the civil war [to] make the transition to freedom” (DeFord and Schwarz 96).

Abraham Lincoln’s vs Andrew Johnson’s Reconstruction Plan Lincoln shared the uncommon belief that the confederate states could still be part of the union and that the cause of the rebellion was only a few within the states which lead him to begin the reconstruction in December of 1863.
