James Madison’s presidency can be very controversial, many had thought that he had a difficult time pulling away from wars as well as making uninformed decisions that ended up hurting merchants, but even with those setbacks, he is still considered an amazing statesman. This is because he had a lot of history working in the government such as how Madison had completed graduate studies within the law before he had begun involved with the government. This means that he had plenty of knowledge and experience with laws in the government, he had first started out with local politics and began working his way up to the Secretary of State under Jefferson's presidency. Since James Madison was in the position of secretary of state, he had worked closely with Jefferson who had control over key decisions, such as overseeing the Louisiana purchase, which had given him some history of the purchase for future reference. James Madison had also warned the government about the seizure of American ships by France and Britain, which John Randolph had taken into consideration, and said it was contrary to international law. Madison thought that the government needed a better form of money income for the government, so he had created the system of checks and balances. Checks and balances are designed so that the power in the government is separated between different branches specifically designed so that one branch does not have too much power over other forms of government and the people. He had made it so that the constitution specifically states what powers each branch has, this way the branches are unable to take too much power and overcome the government. While writing the constitution congress separated government into legislative, executive, and judicial branches in federal and state governments. According to Article 1 the legislative branch would create laws, the executive branch would enforce the laws, and the judicial branch would interpret laws. The goal of this was to ensure that the government of America did not have too much control over the people which is what Great Britain did to them in the revolutionary war. On Friday, February 8, 1788, James Madison wrote “The Structure of the Government Must Furnish the Proper Checks and Balances Between the Different Departments: Federalist 51”. In this document, Madison discusses in regard to the Constitution the structure of government and its relation to its many parts. How each part should share a relation with the other to keep both part in its’ proper place while respecting the other branch. After reading The Federalist Papers #10, 48, and 51 I believe that James Madison saw human nature as being selfish and self-centered, "Ambition must be made to counteract ambition" (319). Madison continues on to explicate on his previous thought, "It may be a reflection of human nature that such devices should be necessary to control the abuses of government" (319). The devices that he talks about are the checks and balances that Madison declares that the government needs. The government needs the checks and balances because Madison believes that trusting one man to govern everything just feeds the selfishness inside the chosen man, "If men were angels, no government would be necessary" (319).

When the farmers began with the Constitution their efforts was to divide governmental power. To prevent tyranny they needed to separation of power so this created our three branches, legislative (Congress), judicial (Supreme Court), and executive, (The President). This would mean on one person could lead the country alone and make the laws alone. This is where checks and balances come in, no one branch can gain absolute power and they cannot abuse the power that is given. By separation of power provides a system of shared power and to make sure it is fair and equal to all.

Madison’s essay reflects the fear many had of a tyrannical government and the desire to ensure that the country didn’t revert back to that which it had just escaped from. He notes the necessity to prevent any one faction or group from gaining too much power and oppressing those in the minority. The separation of powers was set in place to ensure that this could not happen. Even if one group decides they want something, the other two have the equal authority to prevent it should it not represent the country as a whole.

In Federalist 51, he focuses on how the Constitution divides the power of the government into three branches and so no one branch would have too much power. This was done by using the checks and balances system. Madison believes that each branch should be, for the most part, independent, but, to avoid any branches from abusing its power, no branch should have too much power in choosing the members of another. He says that to follow this rule strictly, the people of the United States would choose all members of all branches, but difficulties would arise as the people may not be aware of the best qualifications for each position. So, the branches check one another and the people elect the members other than in the judicial branch, whose members are chosen by the executive branch.
